Appellant was condemned by a jury on each of the three counts in an indictment. One count charged him with having unlawfully seized a woman in Omaha, Nebraska, and captively transported her from Nebraska into Iowa, for the function of dedicating rape upon her in infraction of 18 U.S.C.A.
Another count charged him with having also done these acts for the purpose of robbing the lady in further infraction of 1201. The last count charged individually that he had transported the woman across the Nebraska line into Iowa for the purpose of debauchery and other unethical purposes in offense of 18 U.S.C.A.
The jury did not evaluate the capital punishment, as it could have done on the very first count, under the accusation therein that the woman had actually not been liberated unharmed, and the court afterwards enforced sentences of 15 years, 5 years and 2 years of imprisonment on the respective counts, with the sentences to run simultaneously.
The couple had 2 kids, 16 and 12 years old. The household cohabited at the Offutt Air Force Base, situated near Omaha. Appellant was a 19-year youth of the black jacket and levi apparel-fashion, unacquainted with his victim, and having a prior felony conviction. The evidence is not weak however of most outstanding strength in its proof of the occurrence of the unlawful seizure, captive transport and perpetration of the rape and burglary as declared by the prosecutrix.
The evidence of regret did not rest alone upon the testament of the prosecutrix, but there were various components, direct along with indirect, supportive of the important things to which she testified. Of direct general corroboration was the testimony of two agents of the Federal Bureau of Investigation as to the admissions which appellant had actually made after his arrest.
